Chancel Repair is often and easily overlooked or misunderstood.
If your client has bought a property for consideration and registration has been completed by the Land Registry without or before the Parochial Church Council registering their interest on the Official Copy of the Register, the risk of chancel repair liability no longer arises.
Any property, however, acquired prior to 13th October 2013 or which did not involve any monetary consideration upon transfer (e.g. inheritance) could still be liable for chancel repair.
The “risk” window is the period between exchange and registration. Therefore the chancel repair indemnity insurance policy should be taken out on exchange (not completion).
